This Website at www.gowithgodtravel.com (the “Website”) is owned by Red Compass, LLC d.b.a. "Go With God Travel" ("we", "us") and is provided for residents of the United States of America only. Using this and all websites owned by Red Compass, LLC, and/or arranging travel through this website constitutes your acknowledgement that you have read and agree to the following terms, rules and regulations without limitation or qualification (“Terms and Conditions”). The Website includes any and all “co-branded” websites linked to or from the Website, to which these same Terms and Conditions apply. Please note that ALL travel bookings are made through independent, third parties, and Red Compass, LLC is not a Seller of Travel, Travel Agency, or otherwise engaged in the providing of travel services.
We may at any time revise these Terms and Conditions. You are bound by such revisions and should therefore periodically review these Terms and Conditions. Your continued use of this Website shall indicate your acceptance of these Terms and Conditions as amended. If you do not agree to the Terms and Conditions, please do not use this Website.
1. Travel Information
· Our Website displays information about travel locations, airfares, flight times and dates, tours, packages, insurance, cruises, transportation, foreign currency, schedules, travel companies and many other things.
· This information is supplied to us by third party providers; such are airlines, hotels and transportation suppliers ("Service Provider"). We have taken reasonable care to ensure it is correct and up to date; however we cannot check the accuracy of such information.
· The services which comprise your travel booking are provided by the Service Providers. The Service Provider provides these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier's liability to you. Red Compass, LLC, d.b.a. "Go With God Travel" is not a Seller of Travel, and is not directly involved in any transactions related to travel.
· We accept no responsibility for information supplied to us by third parties. We recommend you confirm all information contained on or linked from our Website with the third party provider.
· The details of the prices, packages, tours, flights and other information displayed on the Website are subject to change without notice. The travel products and services described on the Website are subject to availability.
· It should be noted that most documents issued to travelers are non-transferable. Such documents may include but are not limited to, airline tickets, hotel vouchers, tour vouchers, or any other document used to confirm an arrangement with a Service Provider. Such documents may also be subject to conditions such as, but not limited to, being non-refundable, non-date-changeable and subject to cancellation or amendment fees. It is your responsibility to familiarize yourself with these conditions.
· If for any reason, any Service Provider is unable to provide the services for which you have contracted, your remedy lies against that Service Provider, and not against us. In the event payment was received by Credit Card, you agree that you will not seek to chargeback or recover your payment or any other losses.
· You are responsible for obtaining all passports, visa and health information required.
2. Prices
Special conditions may apply to the prices set out on the Website. To determine such conditions, you must contact us or the relevant Service Provider.
Cancellation and/or change penalties will apply to any cancellation or change that affects your reservation. Penalties can amount to 100% of total payments. We recommend purchasing insurance to protect against covered unexpected events.
3. Insurance
Many of the problems for which we cannot be held responsible for can be insured against. We highly recommend that you take out insurance to provide adequate cover for medical expenses, personal accident, loss of baggage and curtailment or cancellation of trip. Individuals are responsible to finance on the spot medical treatment and other contingencies, and then to reclaim this from insurance, if covered. You will be required to provide documentation to the insurance company to facilitate a claim. Please note that there are exclusions to coverage of insurance. It is our responsibility to be familiar with the insurance coverage purchased and ensure that the coverage meets your travel needs. Insurance has be purchased and paid for in full as soon as the booking is made to become fully effective.
4. Specials
"Specials" are available for a limited time. You must check with us whether a "special" displayed on our Website is still available. There may be particular terms and conditions that apply to "specials". You must contact us or the third party provider of the "special" to determine whether any particular terms and conditions apply.
You must pay for "specials" booked by you and confirmed by us within 72 hours of booking confirmation, unless otherwise agreed by us in writing. Failure to pay for the "special" within this time may result in cancellation of the booking. We accept no responsibility for loss incurred due to cancellation in these circumstances.
5. Special Requests
Should you have any special requests, you must advise the Service Provider at the time of the booking and clearly note it on booking. We cannot guarantee that your special request will be fulfilled. Failure to meet any special request does not signify a breach of contract.
We also regret that conditional bookings cannot be accepted, such as ones that are specified to be conditional on the special request or fulfillment. All such bookings will be considered a "regular" booking with a provision of the possible accommodation of the special request.
6. Suitability of Travel Products and Services
We do not represent that any travel products and services set out on our Website will be suitable for you. You release us from any claims in relation to the travel products and services described on our Website, including but not limited to claims that the travel products and services are not suitable. Service Providers are independent parties over which we have no control. The information and description given about the Service Providers and their products are based on our inquiries and are believed to be accurate, but we cannot guarantee in respect thereof.
7. Tickets and Timings
All reference to departure times on our Websites are for your guidance and are subject by amendment by the wholesalers and/or suppliers prior to actual booking. It isn't until full payment has been made and you are ticketed that the departure times are set. You must check your itinerary at each stage of the booking process to ensure you have the correct flight times. It is possible that flight times will change even after tickets have been issued; in such cases you will be advised of prior to departure, provided the personal information you provided us is correct and up to date.
8. Intellectual Property
All software, design, textual, graphical and other content created by or for us, compromised and appearing on this Website and the selection and layout of this Website, are owned or licensed by us and are protected by USA intellectual property laws. We own the copyright in the Website as a collective work and/or compilation, and in the selection, coordination, arrangement and enhancement of such content. Republication or citation of any content generated by the Website without our written consent is expressly prohibited. This Website may contain other proprietary notices and copyright information, the terms of which must be observed and followed.
You may view and electronically copy the pages of this Website in the usual operation of your web browser in visiting this Website, but for no other purpose. WE HAVE NO LIABILITY AND WILL NOT REFUND DUE TO AN EVENT DUE TO DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE, TERRORISM, AND ANY OTHER CAUSES THAT IS BEYOND OUR DIRECT CONTROL. WE HAVE NO CONTROL AND ARE NOT RESPONSIBLE FOR ANY ADDITIONAL EXPENSES, DELAYS, OMISSIONS, RE-ROUTING, OR OF ACTS OF INTEREFERENCE BY THE GOVERNMENT OR LEGAL AUTHORITIES.
16. Tax Recovery Charges
Amount displayed as Taxes & Fees consists of tax recovery charges, in the respective amounts that we must pay to our service providers in connection with facilitating your travel booking, equal to certain taxes, governmental fees and other charges payable by each such supplier, including without limitation (as applicable): (i) the 7.5% Federal Excise Tax on domestic flights and all applicable fuel surcharges; (ii) Airport Passenger Facility Charges of up to US$18.00, depending on itinerary; (iii) Federal Segment Fees of US$3.20 per segment (defined as a takeoff and a landing); (iv) the September 11th Security Fee of US$2.50 per flight segment (maximum charge per trip of US$5.00 one-way, US$10.00 round-trip); (v) a Travel Facilities Tax of up to US$14.00 per round- trip for domestic flights beginning or ending in Alaska or Hawaii; (vi) for international itineraries, foreign and U.S. government-imposed charges of up to US$200.00 per round trip, depending on routing and destination; and (vii) all state, local and other taxes and fees applicable to the non-air components of your package, such as hotel rooms and rental cars.
17. Governing Law
To the maximum extent permitted by law, these Terms and Conditions and your use of the Website are governed by the laws of State of Florida. You hereby consent to the non-exclusive jurisdiction and venue courts in Saint Lucie County in the State of Florida in all disputes arising out of or relating to the use of this Website and these Terms and Conditions.
18. Amendments
Except as otherwise specified, we may amend these Terms and Conditions at any time without notice to you by posting amended Terms and Conditions on our Website. The amended Terms and Conditions will take effect immediately when they are posted on our Website.
19. Termination
We may terminate Terms and Conditions, and any other agreement between us, immediately if you breach any of these Terms and Conditions.
20. Our Relationship
No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended to be created between you and us by these Terms and Conditions.
21. Additional Information and Financial Security Arrangements
The Aviation Consumer Protection Division of the Federal Department of Transportation is responsible for issues relating to airline consumer travel. Under the Fair Credit Billing Act (US), consumers that purchase airline tickets from an airline that subsequently fails are entitled to a refund or credit from the credit card issuer. Under the USA Aviation and Transportation Security Act of 2001 (Public Law 107-71, 19 November 2001) the Century of Aviation Reauthorization Act of 2003 (P.L. 108-176, 12 December 2003), and the Intelligence Reform and Terrorism Prevention Act of 2004 (8 December 2004) other airlines based in the USA are required to provide transportation to holders of tickets on other USA-based airlines that have ceased operations due to insolvency or bankruptcy, "to the extent practicable", provided that the passenger makes arrangements with another airline within 60 days of the shutdown of the ticketed airline. The USA Department of Transportation has interpreted this in a series of guidance letters (administrative rulings) to mean that other USA-based airlines flying the exact same route are required to honor tickets of a USA-based airline that shut down, on a space-available (standby) basis, for no more than US$25 per person per flight, one-way.
22. General
· If any of these Terms and Conditions is in invalid or unenforceable, it will be struck out, and the remaining terms will remain in force.
· Headings are for reference purposes only.
· If we do not act in relation to a breach by you or others of these Terms and Conditions, this does not waive our right to act with respect to subsequent or similar breaches.
· In these Terms and Conditions, the term "Website" includes any email bulletins or other content that we provide to you via or initiated from this Website.
23. Other Conditions
It is your responsibility to comply with terms, conditions or requirements of any service provider, or any country or governmental authorities, or to bear any costs or losses incurred as a consequence of you not complying with them.
By booking travel through Go With God Travel, you acknowledge that you have researched, reviewed and agree to the terms of service for each service provider (airlines, hotels, attractions, optional excursions, transportation, etc.) included in your itinerary.
If for any reason, any Service Provider is unable to provide the services for which you have contracted, your remedy lies against that Service Provider, and not against us.
Red Compass, LLC reserves the right to, at their sole discretion, charge a service/agent fee which may be up to $250.00. Your final price quote will include any such fee, with this portion to be billed as a separate transaction. This service fee is 100% non-refundable, non-transferable in the event of cancellation or change that affects your reservation.
You are responsible for obtaining all passports, visa and health information required.
Although most travel, including travel to international destinations is completed without incident, travel to certain destinations may involve greater risks than others. We urge you to review and evaluate travel prohibitions, warning, announcements, and advisories issued by the government and the aviation administration before booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found on public sites, such as www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac, and www.customs.gov.
Red Compass, LLC does not represent or warrant that travel to any particular point is advisable or without risk. Red Compass, LLC does not accept liability for damages, losses, or delays that may result from improper documents for entry, exit, length of stay, or from travel to such destinations.
BOOKING ARANGEMENTS
The person initializing or modifying the booking shall be deemed to have accepted the booking conditions.
CONSUMER PROTECTION
Complaints procedure: Should you have a complaint in respect to your trip, booking arrangement or itinerary, you can contact customer service through customersupport@gowithgodtravel.com, or writing our office at: Red Compass, LLC, Attn: Customer Service Department, P.O. Box 7248 Port Saint Lucie, Florida 34985.
Data protection: 1. In order to process your tour booking, Red Compass, LLC will need to use personal information for you and other passengers in your booking, which may include each passenger's name, address, phone number, email address, passport number, credit/debit card number and sensitive information such as health, medical, dietary, mobility, religious or other special requirements. This personal information may be passed on to other suppliers for your travel arrangements in addition to public authorities (such as customs and immigration), security and credit checking organizations, and otherwise as required by law. Similarly, we may also need to provide personal information to contractors who provide services to or for us (such as sending mail, processing payments, providing marketing assistance). This may involve sending personal information (including sensitive information) to other countries that may not afford the same level of protections of personal information. 2. We may also use the personal information you provide us to review and improve the tours and travel services that we offer, and to contact you (by post, email and/or phone) about other tours and services offered by Red Compass, LLC that you may be interested in. If you don't want to receive this information or want a copy of the personal information we hold about you, write to us at Red Compass, LLC, Attn. Marketing Department, P.O. Box 7248 Port St. Lucie, FL 34985. Red Compass, LLC may charge a fee for supplying you with this information as permitted by law.
GO WITH GOD TRAVEL PROCEEDS-SHARING PROGRAM
TERMS AND CONDITIONS
These terms and conditions (“Program Terms”) regarding the Go With God Travel Proceeds-Sharing Program apply to Red Compass, LLC, d.b.a. "Go With God Travel," a Florida Limited Liability Company, located at 1143 SW Curtis Street, Port Saint Lucie, FL 34983, USA (“Go With God Travel” and/or “GWGT”), the Traveler (defined below), and the Recipient (defined below.) “Traveler” shall refer to: a.) the individual or entity booking or reserving travel services through Go With God Travel, b.) the individual or entity submitting payment to GWGT for travel services, and c.) the individual or entity to consume travel services booked or reserved through GWGT. “Recipient” shall be defined as the individual, organization or entity elected by Traveler to receive Contribution (defined below). “Proceeds” refers to the commission(s) paid to and received by GWGT from a travel service provider as a result of a Traveler arranging travel services through GWGT. “Contribution” refers to the payment submitted by GWGT to Recipient for advertising services, directly rendered or not. The “Percentage” or “Portion” shall be thirty-three percent (33%) of GWGT’s Proceeds, unless otherwise agreed to in writing.
Go With God Travel facilitates a “Proceeds-Sharing Program.” For the purposes of these Program Terms, a “Proceeds-Sharing Program” is where an organization or merchant agrees to share a set percentage of its proceeds with either the customer or an entity of the customer’s choosing. This entity will receive a
By booking travel services through Go With God Travel, Traveler represents to GWGT that he or she has read and understand these Program Terms, and agree to be bound by these Program Terms without modification.
ADDITIONAL DEFINITIONS
“Transaction(s)” refers to a Traveler’s booking of travel services or placing of travel reservation(s) and submitting payment for such travel services through GWGT.
“Consumed Transaction(s)” refers to a travel service that have been used or “consumed” by the Traveler, such as a completed trip or hotel stay, which has resulted in commission payment to GWGT.
"Flight-only bookings" are travel reservations in which only airline flights have been booked, and all other travel services (hotel accomodations, car rentals, etc.) are absent.
“Website” means www.gowithgodtravel.com, and all co-brand sites linked from or associated with it.
“Program Terms” refers to and includes GWGT’s Terms of Service, Booking Conditions and Privacy Policy, as can be found and is readily available on the Website.
TRAVELER OBLIGATIONS
It is the Traveler’s sole responsibility to furnish GWGT with accurate information pertaining to the desired Recipient, and successfully communicate his or her choice of Recipient in a reasonably timely manner (within ninety (90) days of Consumed Transaction) for such Transaction to be linked to Recipient. Neither the Traveler nor the Recipient shall have a claim against GWGT for the payment of such monies as a result of a Traveler’s failure or inability to communicate this information. This scenario shall neither undermine nor impact GWGT’s rights to engage in a Transaction with a Traveler notwithstanding.
WEBSITE AND GWGT CONTENT
All contents on the Website are the Copyright(c) 2011 Red Compass, LLC. Contents include, but are not limited to, text, graphics, logos, icons, multimedia clips, digitized download, database information and software. All rights not expressly granted are reserved. The compilation of these contents on this Website are the property of Red Compass, LLC and/or its business partners and are protected by U. S. and international copyright laws.
GWGT’s ownership of Website, GWGT Marks and GWGT content. GWGT shall own all intellectual property rights (including, without limitation, all copyrights, patents, trademarks and trade secrets) in connection with and in (i) all versions of the Website and (ii) the GWGT Marks. “GWGT Marks” shall mean GWGT’s trade names, trademarks, service marks, and/or other visual representations thereof, including logos, designs, symbols, word marks, images, colors and color combinations, trade dress, characters and other publicity rights, or other indicia of ownership owned or used by GWGT. The Website, GWGT content and the GWGT Marks are owned by GWGT and nothing herein grants any ownership interest in or license to use, the elements of the Website, GWGT content and the GWGT Marks to Recipient.
Trademark Protection. Travelers and Recipients are prohibited from using or displaying (either directly or indirectly), and agree not to use, display, or reference (directly or indirectly), any URL, trade name, trademark, logo, or branding of GWGT or GWGT travel suppliers in any manner whatsoever (including, without limitation, in any meta-tags, search engine advertising, marketing or optimization, any other online or offline marketing or advertising, press releases, etc.) without the express, written permission of GWGT. All rights not expressly granted are reserved by GWGT. Any breach of this clause will result in irreparable harm to GWGT and/or GWGT travel suppliers, as well as damages that are difficult or impossible to calculate. Traveler agrees that compliance with this clause may be specifically enforced in any court of competent jurisdiction, without prejudice and in addition to GWGT’s and/or GWGT travel suppliers’ right to seek damages or other remedies for any such breach.
TERMINATION; TERMINATION OBLIGATIONS
GWGT in its sole discretion and without cause may terminate this Proceeds-Sharing Program immediately. The rights and remedies provided in these Program Terms are not exclusive and are in addition to any other rights and remedies provided by law or these Program Terms.
Upon termination or expiration of these Program Terms for any reason, GWGT reserves the right to withhold Recipient's final remittance of Contributions for a reasonable time to ensure that the correct amount is paid.
Inability to Receive Contributions. If circumstances beyond the control of Go With God Travel prevent the conveyance, submission or transfer of Contribution to Recipient, including but not limited to postal delay or error, inability of Recipient to receive mail, or any other reason, the costs involved in Contribution resubmission, including but not limited to postal charges, cancelled check charges, and all other processing charges, shall be deducted from the Contribution owed to the Recipient. No resubmission of Contribution shall be made on checks that have been cashed or deposited. In the case of postal or check fraud, Recipient’s remedy lies with the relevant postal service, financial institution, or the Recipient’s attorney. GWGT disclaims any and all liability from any assistance or costs involved in the investigation into and/or resolution of such matters.
Effect of Economic Conditions. In the event GWGT deems, in GWGT’s sole discretion, that military or terrorist action or extraordinary political, economic, or other conditions or occurrences beyond GWGT’s control significantly impact the travel industry or GWGT’s businesses, GWGT may, at any time, suspend performance (in part or whole) of any or all of the terms and conditions of these Program Terms, suspend Contributions due hereunder (in part or whole) or terminate the Program (in part or whole), at GWGT’s sole discretion.
Contributions. In accordance with and subject to all conditions set forth in these Program Terms, GWGT shall pay Recipients Contributions, calculated as a specific Portion of GWGT Proceeds. For the avoidance of doubt, Contributions will only be paid on Consumed Transactions.
GWGT will pay a Recipient of the Traveler’s choosing thirty three percent (33%) of the Proceeds received as a result of a Consumed Transaction, unless a different percentage is agreed to by GWGT in writing.
It should be noted that, in most circumstances, Go With God Travel does not receive commission payments for flight-only bookings. As a result, this proceeds-sharing program shall not apply to flight-only bookings.
In no event shall Proceeds include (i) the price due or payable by GWGT to one or more suppliers or intermediaries; (ii) any payments for claims, offsets, cancellations, refunds, rebates, customer service allowances, retroactive price adjustments, returns, and other deductions; (iii) fraudulent or prohibited transactions, including, but not limited to, any transaction based on a reservation that is speculative, duplicative or fictitious; or (iv) any sales, excise, use, goods and services, harmonized, withholding, value-added or other similar taxes.
Tax Forms. As an entity required to file information returns with the IRS, Red Compass, LLC must obtain the correct TIN (tax identification number) of all recipients to which we pay Contributions. This may be in the form of a Social Security number for individuals, or an Employee Identification number for organizations. An IRS form W-9, also known as "Request for Taxpayer Identification Number and Certification" is used by a U.S.-based individual or entity, or a resident alien to verify his or her taxpayer identification number (TIN). If you are defined as a "foreign person" for federal tax purposes, the IRS requires you to use the appropriate W-8BEN form or provide a signed Certification of No U.S. Activities, depending on which form is applicable. Prior to receiving all Contributions, the Recipient must complete and return to Go With God Travel the appropriate tax form. GWGT shall make all reasonable efforts to collect such forms from designated recipients, but shall be under no obligation to the Traveler in the event that a Recipient refuses or is unable to provide GWGT the applicable form. Recipients shall be solely responsible for any and all taxes and/or other obligations associated with the receipt of Commissions hereunder.
Negative Balances. GWGT may apply a negative balance owed to a Recipient on future Contributions in an amount equal to a Contribution previously submitted to Recipient in circumstances of: (i) product/service returns; (ii) duplicate entry or other clear error; (iii) retraction of commission(s) previously paid to GWGT by service provider on which Recipient received a Contribution; (iv) a Traveler’s failure to comply with these Program Terms; or (v) invalid Transactions. GWGT may withhold future Contributions due to Recipient and credit such amounts payable towards offsetting or recouping any Contribution amounts paid in error by GWGT on prior Transactions.
Recipient must cooperate fully, and provide GWGT with all reasonable assistance as requested by GWGT, in connection with any investigation by GWGT into suspected Transaction fraud.
Facilitating Payment of Contributions. GWGT shall have no obligation to make payment of any Contributions resulting from Transactions for which GWGT has not received payment from the relevant travel suppliers of all monies due to GWGT.
Tax Status and Obligations. GWGT is not obligated to and shall not provide Recipient with tax and/or legal advice. GWGT undertakes no duty to investigate or research Recipient’s tax status and/or obligations, and such research and investigation is solely Recipient’s responsibility. Recipient is obligated to independently assess and comply with all relevant tax and legal requirements and shall be responsible for any and all taxes, duties and impositions imposed on Recipient resulting from the receipt of Contributions, including interest and penalties thereon and additions thereto.
All Recipients who receive payouts totaling more than $600 during the course of the year shall be issued an IRS Form 1099 or 1042, where appropriate.
